A Broken System: Nursing Home’s Fall Prevention Failures Lead to Resident’s Fatal Injuries

Danbury Hudson Ohio Faces Nursing Home Abuse Lawsuit for Death of Resident

Rosemarie Repas died after suffering miserably for eight days from fractures she sustained as a result of Danbury Hudson’s failures to implement adequate fall precautions to protect her from being injured after she fell at least 12 times over the course of nine months under the facility’s care.

Michael Hill Trial Law is pursuing a lawsuit on behalf of Rosemarie Repas’ family against Ohio-based assisted living facility Danbury Hudson located in Hudson, Ohio. Danbury Hudson is part of the StoryPoint Group family of companies, which has numerous locations across the United States. The case alleges negligence, wrongful death, and violations of nursing home resident rights laws. The lawsuit is Estate of Rosemarie Repas v. 150 Omni Lake Tenant, LLC, aka Hudson Danbury aka Danbury Hudson, et al. and is pending in Summit County, Ohio, Case No. CV-2024-06-2670.

The lawsuit states that Rosemarie Repas became a resident of Danbury Hudson on July 26, 2022. It is asserted that Danbury Hudson knew Ms. Repas was at high risk for falling due to several of her diagnoses at admission including: difficulty walking, unsteadiness on feet, and lack of coordination. Rosemarie’s gait was noted to be “weak” in Danbury Hudson’s fall risk assessment.

Over the course of Ms. Repas first nine months as a resident of Danbury Hudson, it was reported that she fell at least 12 times while under their care and attention. The lawsuit details that after each of Rosemarie’s falls the facility failed to update her care plan in order to put the proper interventions in place to prevent Rosemarie from sustaining further falls. This included updating Rosemarie’s assistance level for transfers from a one-person assist to a two-person assist.

It was noted by Danbury Hudson’s nurse practitioner and other providers that Ms. Repas required the assistance of two people when transferring from one location to another, but the facility never actually updated Rosemarie’s care plan to reflect these changes so all staff members had access.

On September 30, 2023, one of the Danbury Hudson staff members transferred Rosemarie Repas from her wheelchair to her bed by themselves. As the staff member moved Rosemarie from her wheelchair to her bed, Rosemarie’s right foot slid and got caught between the wheelchair and bed. Rosemarie yelled out in pain and the staff member heard a “pop” sound.

It was later discovered by one of Rosemarie’s hospice nurses that Ms. Repas suffered spiral-type fractures to her right lower leg. For the next eight days, hospice care increased Rosemarie’s medications to try to control her pain from the fractures. Rosemarie was bed bound, in extreme pain, not eating or drinking, and noted to be severely declining by the nursing staff.

Rosemarie Repas ultimately died on September 28, 2023. The lawsuit alleges that Ms. Repas’ death was a direct and proximate result of Danbury Hudson’s failures to provide her adequate and appropriate care.

The Ohio Department of Health investigated the incident and cited Danbury for its failures to deliver appropriate care to Rosemarie Repas.
